The main suit itself has concededly been disposed of on February 18,2009 itself. It is on that date only that this Court had ordered that the learned Trial Court shall adjourn the matter to a date beyond the date given by this Court. It appears that the order could not be communicated to the learned Trial court.
The petition shall stand disposed of as infructuous accordingly.
The learned counsel for the petitioner states that he would be filing an appeal against the judgment and decree of the Trial Court and would request for a remand in view of the fact that

this Court had ordered the learned Trial court to adjourn the matter to a date beyond the date fixed which (order) could not be communicated to the learned Trial Court.
It will be for the petitioner to mention the aforementioned plea before the learned Ist Appellate Court, which shall pass an appropriate order on the basis thereof in accordance with law.
