The manner in which the Financial Commissioner, Revenue has dealt with the case is not appreciable as the zimni order dated 8.7.2008 reveals that he had accepted the revision petition and set aside the order. The zimni order further reveals that he had also recorded a separate detailed order in this connection, but on 15.7.2008, he recorded a contrary order which is reproduced as under :-

“While dictating the judgment some new facts have come to notice, the case be fixed for order again on 22.7.2008 at 3.00 p.m.”

While passing the order dated 22.7.2008, she would have taken care of the earlier order recorded by her.

Without commenting on the aforesaid orders, it would be suffice to say that Financial Commissioner Revenue would not have given that much impression. Accordingly, the order dated 8.7.2008 and the subsequent orders thereto are set aside and it is directed that now this revision petition would be heard by some other competent authority to be nominated by the Chief Secretary, State of Punjab.

Copy of the order be sent to the Chief Secretary, State of Punjab. The nomination with regard to authority would be notified to the parties.
