On February 15, 2008 while disposing of writ petition filed by the petitioner and others, the Division Bench of this Court directed the respondents to decide the legal notice Annexure P-3 therein within a period two months.
While filing the present contempt petition, the petitioner asserted that the respondents did not decide the aforementioned legal notice.
Reply has been filed on behalf of respondent No.2. In para 4 of the same, it stands mentioned that speaking orders have been passed by the said respondent on 2.1.2009 in compliance with the orders passed by the Division Bench of this Court on 15.2.2008. Copy of the order dated 2.1.2009 has been appended with the reply as Annexure R-1.
A perusal of order dated 2.1.2009 Annexure R-1 would reveal that

the decision was taken in the meeting held on 16.12.2008 to transfer all the ECCE centres along with its workers and helpers working in those centres with infrastructure from Education Department to the Department of Women and Child Development w.e.f. 1.4.2009 and the petitioner and similarly situated persons would be adjusted and their grievances, accordingly, readdressed.
In view of the above, the petition has been rendered infructuous and is, accordingly, disposed of. Rule is discharged.
However, respondent No.2 is directed to implement its order dated
2.1.2009.
