The State of Punjab has filed the present appeal for reduction in the compensation awarded to the landowners/respondents.
Briefly, the facts are that the State of Punjab acquired the land within the revenue estate of Village Saneulian vide notification dated 14.12.1982, issued under Section 4 of the Land Acquisition Act, 1894 (for short, 'the Act'), for construction of Sutlej Yamuna Link Canal. The Land Acquisition Collector assessed the market value of the land at Rs. 13,200/- per acre for chahi and Rs. 10,000/- per acre for Rauali/ Gair mumkin kind of land. On reference under Section 18 of the Act, the learned court while relying upon an earlier award, Ex. A-1, enhanced the compensation to Rs. 45,000/- per acre for chahi and Rs. 24,000/- per acre for Rausli/ gair mumkin/ Dakar kind of land.
Learned Assistant Advocate General, Punjab, very fairly stated that issue involved in the present appeal is squarely covered by the Division Bench of this court in L. P. A. No. 49 of 1988 Sant Ram vs The State of Punjab and another, decided on 8.1.2002, whereby the award of the Collector was upheld.
For the detailed reasons recorded in Sant Ram' s case (supra), the present appeal is dismissed.
