1. On 29.5.2008 we have raised a query as to whether the petitioner could deposit the arrears of toll as per order dated 18.2.2008 (Annexure P-9). According to the aforementioned order the petitioner had deposited 10th instalment of Rs. 74 lacs and some amount for the 11th instalment i.e.Rs.19 lacs as against Rs.75.30 lacs. The 12th instalment, which was due on 15.2.2008, has not been paid. There is huge arrears of amount for the toll as per order dated 18.2.2008 (Annexure P-9). We had adjourned the matter on the request made by learned counsel for the petitioner to enable him to seek instructions as to whether the petitioner was prepared to deposit the aforementioned amount .
