On December 11, 2007 and March 15, 2008 the petitionercomplainant had stated before the court that last opportunity be granted for concluding her entire evidence and on her failure to do so, the evidence may be deemed to have been closed. Inspite of that the evidence was not produced. The complaint in the present case is under Section 406 of IPC filed on December 14, 2002 and the matter is still pending at the charge stage.
Keeping in view these facts I do not find any illegality in the
order passed by the court below.
The petition is dismissed.
