Sudesh Vs Lashkar Singh

The petitioner was proceeded against ex-parte vide judgment (Annexure P2). Petitioner had filed an application (Annexure P6) for setting aside the ex-parte decree. This application was filed on 2.8.2007. Before that, on 14.6.2007 warrants of possession were issued. Learned counsel for the petitioner states that application (Annexure P6) has not been decided till today.

This Court, on 10.8.2007, had only stayed the execution proceedings. The proceedings arising out of application (Annexure P6) for recalling of the ex-parte order were not stayed.

Learned counsel for the petitioner states that till now no proceedings have taken place arising out of application (Annexure P6).

In view of this, learned Rent Controller is directed to decide the application (Annexure P6) within two months from today, till then execution proceedings be not carried.

The present revision petition is disposed off.
