This Revision Petition is at the instance of the plaintiff whose application under Order 39 Rules 1 and 2 read with Section 151 CPC for the grant of ad-interim injunction against dispossession has been dismissed by the Courts below.

The afore-stated application was moved in a suit for Permanent Injunction filed by the petitioner/plaintiffs against the Gram Panchayat of Village Shera.

While issuing notice of motion, this Court on 1.8.2003 directed the parties to maintain status-quo qua the land in dispute.

The said interim order is still operating.

¶13

The record reveals that the civil suit was filed in the year 2000. Having regard to the nature of the suit, there is every likelihood that by now the same might have been decided on merits.

In any case, the direction to maintain status-quo has

been operating for the last over five years and the parties have reconciled with the same. In these circumstances, I do not deem it appropriate to go into the merits of this revision petition as it may unnecessarily prejudice either of the parties.

Consequently, this revision petition is disposed of with a direction that in case the civil suit is still pending, the parties shall continue to maintain status-quo till the disposal thereof. However, if the suit has already been decided, this revision petition shall be deemed to have been disposed of as infructuous. No costs.
