Learned counsel for the petitioner has sought to argue that the petitioner has tendered resignation from the Directorship of the Company as far back as on 25.05.1997. However, there is no document showing that either any intimation in that regard was sent to the Registrar of Companies or to any of the secured creditors.
At this stage, learned counsel requests for withdrawal of the writ petition with liberty to file fresh one on the same cause of action with detailed particulars and by bringing on record all other relevant documents.
Dismissed as withdrawn with liberty aforementioned.
