This is petition for grant of anticipatory bail. Case is for the offence under Sections 307/326/325/324/148/149 IPC.
Counsel for the petitioners argues that the father and all the five sons have been falsely involved and the injury bringing the case for the offence under Section 307 IPC is not attributed to the present petitioners. It is also argued that Harpal Singh petitioner No.2 had also received certain injuries. It is further argued that the father to whom main injuries bringing the case for the offence under Section 307 IPC are attributed, is in custody whereas some of the co-accused have already been released on bail. It is argued that Sahib Singh petitioner No.1 is 18 years old.
I have gone through the FIR. I find that the FIR was registered seven months back and during this time, some of the accused have been arrested and even released on regular bail whereas present petitioners have been absconding all this time.
