Petitioner Subhash has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.66 dated 19.1.2006 registered under Sections 147/148/307 IPC and Sections 25 and 27 of the Arms Act at Police Station Sadar, Hisar, District Hisar.
I have heard the counsel for the parties.
In this case, as per the prosecution version, the petitioner caused firearm injury to Rajesh on the left leg below the knee. The petitioner is in custody since 25.1.2006. Counsel for the petitioner contends that in this case three prosecution witnesses have been examined including the complainant and the injured Rajesh and they have not supported the prosecution version.
In view of the above, without expressing anything on the merits of the case, I deem it appropriate to grant regular bail to the petitioner and he is accordingly ordered to be released on bail to the satisfaction of the trial Court.
