This is third petition filed by petitioner Sarabjit Singh alias Sarba under Section 439 of the Code of Criminal Procedure for the grant of regular bail in case FIR No. 139 dated 28.10.2003 under Sections 302/ 120B/34 IPC, registered at Police Station Sadar Bathinda.
I have heard counsel for the parties and gone through the contents of the FIR as well as the order dated 5.6.2004, passed by Addl. Sessions Judge, Bathinda, whereby bail application of the petitioner has been dismissed.
I have been informed by the learned State Counsel that the prosecution has completed its evidence and the case is now fixed for defence evidence and arguments. At this stage, I am not inclined to grant regular bail to the petitioner. Even no change in circumstances has been pointed out, except the fact that the petitioner is in custody since 1.11.2003.
Dismissed.
However, the trial court is directed to expedite the trial.
