The present application is filed for initiation of a contempt proceeding against the opposite parties for their willful and deliberate disobedience of the order of this Court dated 02.11.2023 passed in CWJC No. 11045 of 2023.

3.Mr. Sajid Salim Khan, learned Senior Advocate appearing on behalf of the respondent-opposite parties referring to supplementary show cause affidavit filed on behalf of the opposite party no. 3 has submitted that this Court while passing the order under contempt had observed that if the petitioners file their representation within a period of 4 weeks from today, the same shall be considered and disposed off by a reasoned order preferably within a period of 8 weeks. It was also made clear that the respondent no. 3 shall be under obligation to consider the documents/papers relating to the land in question filed on their behalf before passing the final order. Drawing the attention of this Court to the averments made in the second show cause affidavit and the final order passed by the respondent no. 3 dated 16.01.2026, it is submitted that the concerned respondent has considered every document submitted by the petitioners and finally come to the conclusion by passing a detailed reasoned and speaking order and after giving adequate opportunity of hearing to all the concerned that the lands in question have been

encroached upon by the petitioners and others.

Having considered the submissions advanced and taking note of the detailed order passed by the respondent no. 3, this Court finds that the order of this court dated 02.11.2023 has already been duly complied with and as such continuation of the present contempt proceeding is not warranted.

In view of the aforesaid facts, the present contempt proceeding stands closed. However, if the petitioners are aggrieved with the order passed by the opposite party no. 3, they have remedy available under the law.
