Heard the learned counsel for the parties.

The present contempt petition has been filed for non-

compliance of order dated 29.11.2018, passed in C.W.J.C. No.1926 of 2017, whereby the writ petition was disposed of without expressing any opinion with regard to maintainability of the writ application against BISCOMAUN, in terms of order dated 12.05.2016, passed in C.W.J.C. No.9190 of 2014 (Harindra Choudhary Vs. The State of Bihar & Ors.), wherein it was stated that on an application being filed by the petitioner with regard to his claims since he is retire of 2008, the same will be considered and the settlement will be made within a reasonable time frame

keeping in mind the chronological order, which is maintained.

The learned counsel appearing on behalf of the BISCOMAUN submits that in the chronological list, the serial number of the petitioner is 1678, which is available in public domain and can be viewed on the official website of the BISCOMAUN. He further submits that the Group Insurance, Gratuity, Part Salary and Provident Fund has been paid to the petitioner on different dates and no person below the petitioner has been paid the entire amount and there are thousands of other retired employees and widow ladies, who are waiting for their turn as per the chronological order. It is further submitted that several writ petitions and contempt petitions have been disposed of by this Hon’ble Court (Annexure-A series to the show-cause), whereby this Hon’ble Court has recorded that petitioner will have to wait for his turn and the Court will not pass any order to break the queue at the cost of, may be, more needy and patient litigant.

In view of the above, the present contempt petition stands disposed of in terms of the statement made in paragraph nos.3 to 5 of the show-cause filed on behalf of the BISCOMAUN.
