The instant writ application has been filed for directing the respondents, particularly Respondent No.4, to grant the full monetary benefits in terms of the Resolution issued by the Education Department, Government of Bihar, contained in Memo No.1071 dated 07.10.2021 and the consequential Letter No.2796 dated 18.11.2021 issued by the District Education Officer, Purnea, for which the petitioner has already filed a representation dated 03.11.2025, and for grant of any other appropriate relief(s) to which the petitioner may be

found entitled in the facts and circumstances of the case.

Learned counsel for the petitioner submits that the petitioner is the husband of the deceased employee, namely, Late Purnima Kumari, who served in the Education Department for about 32 years and finally superannuated from the post of In-charge Principal, Middle School, Singhiya Diwanganj, Purnea Sadar East, on 31.03.2017. It is submitted that despite having rendered service from 01.04.1985 till 31.03.2017, certain monetary benefits admissible to the deceased employee have not been extended. It is further submitted that a representation in this regard has already been filed before the District Education Officer, Purnea, on 05.11.2025.

It is further submitted that the deceased employee died on 14.10.2020 and, till date, her claim for grant of benefits under the Assured Career Progression Scheme has not been adjudicated.

On the other hand, learned counsel for the State submits that appropriate directions may be issued to the concerned authorities for considering the case of the deceased employee for grant of such benefits if the claim is found to be justified.

Education Officer, Purnea, is directed to place the case of the deceased employee, namely, Late Purnima Kumari, before the Screening Committee constituted for considering claims under the Assured Career Progression Scheme within a period of four weeks from the date of receipt of a fresh representation to be filed by the petitioner along with all supporting documents, including a copy of this order, within a period of three weeks from today.

It is expected that, upon receipt of such representation, the claim of the deceased employee shall be placed before the Screening Committee, which shall consider and decide the same by passing a reasoned and speaking order within a period of eight weeks. If the deceased employee is found entitled to the benefits claimed, the consequential monetary benefits shall be released in favour of the petitioner, being the legal heir, after due verification of his bona fides.

With the aforesaid observations and directions, the writ application stands disposed of.
