The present application has been preferred for the

(i) for quashing the Notice dated 04.03.2025 (Annexure-9) and entire proceeding passed in Jamabandi Cancellation

Case No. 311 of 2024-25 (The State through Circle Officer, Mashrak Vs. Kashi Nath Ray and others) issued by the Additional Collector, Saran at Chapra (Respondent No. 5) whereby the said respondent directed to the petitioners that Jamabandi Cancellation Case initiated relating to Jamabandi No. 1221, running in the name of Late Mahesh Rout, VillageBahrauli its Revenue Thana No. 16, connecting Khata No. 46, Survey Plot No. 2170 admeasuring in Area of 9 Katha 8 dhur under Revenue Circle/ Block- Mashrak in the District of Saran.

For directing the respondents to not disturb the peaceful possession of the petitioners upon the abovementioned subject land situated under Khata No. 46, Survey Plot No. 2170 admeasuring in Area of 9 Katha 8 dhur bounded Khand, as in North-Ramkishun Rout in South East- Road, West- Ramkishun under Jamabandi No. 1221 which is running in the name of Grandfather of the petitioners namely Late Mahesh Rout of the subject land on the basis of Patta dated 25 वैशाखसन् 1352 साल (1942AD) situated under Revenue Circle / Block - Mashrak in the District of Saran because the said Jamabandi is running since very long which has been protected by mandates of Hon'ble Court passed in a cases of Ramanandan Singh Vs. The State of Bihar, Jagarnath Jha Vs. the State of Bihar, Nathuni

III. And any other writ(s), order(s), direction(s) to which the petitioner which may deem just proper and necessary in view of the facts and circumstances discussed herein under.

The counter affidavit of the Circle Officer, Mashrak,

Saran shows that though Jamabandi Cancellation Case No. 311 of 2024-25 has been instituted, only notice has been issued to the petitioner and aggrieved, the writ petition.

This Court is also of the opinion that when the matter is still pending before the Additional Collector, Saran at Chapra, it would be appropriate that petitioner present all the facts/ documents under their belt so that an appropriate reasoned order can be passed.

Learned counsel for the petitioner submits that appropriate steps shall be taken to appear/ contest the matter.

Taking note of the aforesaid fact, the writ petition is disposed of.
