Learned Counsel for the petitioner submits that case has been listed under the heading ‘on office notes’ in which defect has been pointed out to provide a copy of Anganbari Appeal No. 8 of 2023 along with the relevant documents of appeal. intimated that Anganbari Appeal No.8/2023 is still pending before the Collector, Saharsa.

In this background, Counsel for the petitioner submits that the present writ petition may be disposed off directing the Collector, Saharsa, to pass order in the Anganbari Appeal No.8/2023.

This Court is aware that defect has been pointed out under the office notes’, but it is also true, as per the submission, that statutory appeal is still pending since 2023. Therefore, this Court without entering into the merit and demerit, dispose off the writ petition directing respondent No.4 to pass order on Anganbari Appeal No.8/2023, if not disposed off till date, within 60 days.
