This writ application has been preferred for grant of

following reliefs:-

For quashing the order dated 09.01.2024 putting signature thereon dated 28.02.2026 passed by the Additional Collector, Jamui in Jamabandi Cancellation Case No. 08/2021 whereby and whereunder aforementioned Jamabandi case filed on behalf of the private respondent no. 8, namely, Birendra Paswan has been allowed cancelling the Jamabandi No. 58/1816 which has been created in the name of the petitioner and his wife namely Umashankar Devi (now dead)

(ii) For directing the concerned respondents authority to reinstate the Jamabandi No. 58/1816 in the name of the petitioner.

Having considered the nature of the grievance of

the petitioner, This Court is not the appropriate forum to challenge the impugned order.

Learned counsel for the petitioner submits that the appropriate forum is Bihar Land Tribunal (in short "the Tribunal). It is further submitted that at the time of filing of this writ application, the Tribunal was not functioning, however, vide notification dated 29.04.2026, the Tribunal has started functioning.

In such view of the matter, learned counsel for the petitioner seeks permission to withdraw this case with liberty to

approach before the Tribunal against the order dated 29.01.2024 passed by the Additional Collector, Jamui in Jamabandi Cancellation Case No.08 of 2021.

Considering the aforesaid facts and circumstances of the case, this writ application is dismissed as withdrawn giving liberty to the petitioner to avail the appropriate remedy available to him before the appropriate forum.
