In the present writ application, the petitioner has

prayed for the grant of following reliefs:

(i) For issuance of an appropriate writ in the nature of certiorari quashing the office order contained in memo no. 3772 dated 26.11.2025 issued under the signature the respondent registrar Jai Prakash University Chapra, where by and where under the petitioner has been transferred as head of the department (In charge) PG Department of Home Science Jai Prakash

University, Chapra to Department of Home Science, Jai Prakash Mahila College, Chapra and respondent no. 6 who is 16 years junior to the petitioner.

(ii) For issuance of an appropriate writ in the nature of mandamus commanding the respondent authority to consider the case of petitioner to the post of reader and professor with effect from due date with all consequential benefits.

(iii) During the pendency of the writ petition to stay the operation of the office order contained in memo no. 3772 dated 26.11.2025 issued under the signature of registrar of Jai Prakash University Chapra.

(iv) For any other writ(s), order(s), directions(s) that Your Lordship may deem fit and appropriate.

During the course of submission, learned counsel

for the petitioner Ms. Adya Pandey submits that being aggrieved by the transfer order, the petitioner had approached the office of the Hon’ble Chancellor under Section 8 of the Bihar State University Act, 1976 by filing representation dated 01.12.2025 (Annexure P/8) pointing out the irregularity that has been committed. Upon receiving the said representation, the

Chancellor issued a notice to the Vice-Chancellor of the respondent-University by letter no. 2361 dated 19.12.2025 (Annexure-P/9) asking the Vice-Chancellor to submit his reply.

From the averments made in the counter affidavit, it transpires that after receiving the notice from the office of the Chancellor, the Vice-Chancellor of the respondent-Jai Prakash University constituted a three member committee, which submitted a report on 25.03.2026. Based on the said report, the Registrar of the respondent-University is said to have submitted his reply before the Chancellor on 29.04.2026. Since then the matter is pending before the Chancellor and no final decision has taken as yet.

Learned counsel for the petitioner and respondentparties, therefore, jointly submit that this writ application may be disposed of directing the Chancellor to take a final decision in the matter within a fixed time frame, after giving an opportunity of hearing to the petitioner.

In view of the facts and circumstances stated above, this writ application is disposed of directing the Chancellor of respondent-J.P. University, Saran Chapra to take a final decision in the matter within three months from the date of receipt/production of a copy of this order, after giving an

opportunity of hearing to the petitioner. It is further made clear that in case the petitioner is found entitled to the relief which the petitioner has claimed through the representation then the same should be extended to the petitioner within a further period of 15 days from the date of passing of the final decision by the Chancellor.

It is also considered appropriate to observe that the petitioner may join at her transferred place subject to outcome of her representation.

Learned counsel for the petitioner seeks permission to add the Chancellor as a party-respondent in the present case during course of the day.

Permission is granted.

¶38

Office is directed to make correction in the cause title of the case.

With the aforesaid observation/direction, this writ application is disposed of. All pending interlocutory application(s), if any, shall also be deemed to have been disposed of.
