The present writ petition has been filed for the

following relief(s):-

“1. That by this writ application, petitioner seeks indulgence of this Hon'ble Court for issuance of an appropriate writ or writs, direction or directions commanding the Respondents to consider and hand over the shop to the petitioner, which has been legally allotted by the competent authority on 09.03.2022 that would be constructed shopping complex on the land of Zila Parishad, Saran at Chapra, situated beside the Fider Path of Dighwara Railway Station. Petitioner prays for issuance of writ of Certiorary to quash the letter dated 03.12.2025 on the ground of arbitrary, malafide, unreasonable and illegal motive whereby arbitrarily cancelled the allotted shop no.-239 without any show cause or any valid reason.”

Learned counsel appearing on behalf of the petitioner submits that though the allotment of the shop to the petitioner has been made way back in the year 2022 but the possession of the subject shop is not being handed over to the petitioner. Learned counsel seeks a direction from this Hon’ble Court to direct the concerned authority to put the petitioner in physical possession of the allotted shop by fixing a time-frame.

Per contra , the learned counsel appearing on behalf of the respondent Nos. 2 to 4 has stated that after the allotment was made, the petitioner was intimated about the said allotment but, till date the petitioner has not turned up before the competent authority (i.e., the Chief Executive Officer, Zila Parishad, Saran at Chapra) for executing the agreement and completing the other formalities. Learned counsel has stated that in case the petitioner approaches the Chief Executive Officer and executes an agreement then the allotted shop will be given possession of.

5. Having regard to the above made submissions, the present writ petition is disposed of directing the petitioner to approach the the Chief Executive Officer, Zila Parishad, Saran at Chapra within a period of ten days from today. The Chief Executive Officer shall complete the formalities including

entering into the agreement with the petitioner as and when he approaches the said authority and put him in physical possession of the shop once the agreement is executed and other formalities are completed.

6. With the above direction, the present writ petition stands disposed of.
