The present petition has been preferred for the

“(i) For issuance of an appropriate

Writ/Writs, direction/directions or order/orders especially in the nature of Certiorari, to set-aside the order which was communicated vide letter no. 2552 dated 08.12.2025 (Annexure-3)whereby and where under a fine/penalty of Rs.9,01,175/- was imposed by the Respondent authority directing the

Petitioner to pay the said amount within 03 days failing which the vehicle bearing Registration No. BR01GM/4193, Engine No. PMPZ104886, Chassis No. MB1jjLHD3PPMV2738, shall be confiscated.

(ii) Issue an appropriate writ/order/direction for release of the petitioner's Hhya Vehicle (12 Chakka) bearing Registration No. BR01GM/4193, Engine No. PMPZ104886 Chassis No. MB1JJLHD3PPMV2738 seized by Naubatpur police Station, in favour of the petitioner.

(iii) For issuance of appropriate Writ/Writs, direction/directions or order/orders especially in the nature of Mandamus directing the Respondents that during the pendency of the present writ petition, the Respondents may be restrained from taking any coercive step in pursuance of the proceeding. under the Mines Act against the confiscated vehicle.

(iv) For any other relief/reliefs, which the Hon'ble court may grant in general interest, that may be deemed appropriate and necessary in

After some arguments, learned counsel for the petitioner submits that he shall be filing an appropriate petition before the respondent no. 5, the Mineral Development Officer, Patna in next four weeks.

Learned counsel representing the Mines Department submits that it will be taken to its logical conclusion if filed in time.

In that background, the writ petition stands disposed of allowing the petitioner to approach the concerned respondent in four weeks who shall be taking up the matter and after hearing the parties, shall be passing an appropriate reasoned order in accordance with law at an earliest.
