petitioner and Shri N.P. Yadav, learned SC- 23 for the State.

The petitioner in the present writ application has

prayed for the following reliefs:-

i). For commanding the respondents authorities not to disturbed and not to block the entrances from road to the peaceful possession of the petitioner over his Raiyati Land of Khesra no 892 Khata no 22 situated at Mauza -PARNA, P.S.- Nima Chandpura, District-Begusarai, in the facts and circumstances fully enumerated here in below.

(ii). For further restraining the respondent authorities from raising any construction over the land bearing Khata no 167

khesra no 851 which is garimazarua land situated between Main Road and petitioner land i.e. called public path way. And for setting aside The circle officer letter vide memo no 2122 dated 20.07.2024 sent to the District Program officer Begusarai, where by recommended for construction of Aganbari Centre. Due to which the entrances upon the petitioner land is completely closed and the widening of road is also being stopped.

It is the case of the petitioner that the right of

easement will be affected if proposed construction is allowed to be made on the plot in question. In this regard a representation has been filed by the petitioner on 13.01.2025 (Annexure- P/4), which has been received by the respondent authority showing receipt dated 13.01.2025 and no action on the part of the respondent authority has been taken.

Another representation was filed on 17.04.2025 which has not been considered and disposed of and prays for disposal of the respective representations filed by the petitioner.

Accordingly, the writ application is dispose of with direction to the Collector-cum- District Magistrate, Begusarai to consider the respective representation filed by the petitioner and if any action is accentuated then to take appropriate steps in accordance with law within a period of eight weeks from the date of this order.

It is accepted that till disposal of the representation by the District Magistrate, Begusarai, the respondent authority

may not take any action which take away the right of easement of the petitioner.
