The present writ petition has been filed by the petitioner with the following reliefs:

“I. For the issuance of Writ in the nature of Mandamus or any other appropriate Writ(s) or Order(s) or Direction(s) directing the Respondent Authorities to extend the benefit of Accrued / Assured Career Progression (ACP) to the

Petitioner who has completed 24 Years of service which is accruing in lieu of his services but has not been paid yet.

II. For the issuance of Writ in the nature of Mandamus or any other appropriate Writ(s) or Order(s) or Direction(s) directing the Respondent Authorities to consider and pass a reasoned order against the Representation dt. 08.12.2023 filed by the Petitioner with prayer to grant him ACP in the light of departmental guidelines and pass a reasoned order after affording reasonable opportunity of being heard on the representation filed by him.

III. Issuance of such other order/ orders, direction/ directions, relief/reliefs to which the petitioner may found entitled to be passed as your Lordships may deem fit and proper.”

Learned Counsel for the petitioner submits

that for his grievances he has filed representation dated 08.12.2023 ( Annexure-P/3) before the commandant but no order has been passed as yet.

Learned Counsel for the Union of India, on the other hand, submits that from the pleading it transpires that petitioner has made suppression.
