Heard Mr. Sanjeev Kumar, learned counsel for the

petitioner and learned counsel representing the State.

The present petition has been preferred for the grant of following relief(s):

“(i) for issuance of a writ in the nature of certiorari or any other appropriate writ, order/s, directions quashing the order dated 07.08.2025 passed by the respondent no.4 in Jamabandi

correction case no. 56/2025-26 whereby a jamabandi cancellation case has been initiated against the petitioner for cancellation of jamabandi no. 146 running in the name of late Gajadhar Singh, the great grand-father of the petitioner as this case has been initiated on the basis of a wrong conclusion arrived at by the concerned respondents that this Hon'ble Court has vide its order dated 23.10.2024 passed in C.W.J.C. No.10566/2024 has given a direction for cancellation of jamabandi in question although no such direction has been given by this Hon'ble Court (Annexure-P/18).

(ii) to treat the Annexure- P/18 to the petition to be nullity and nonest in the eye of law.

(iii) to hold that the impugned order has been issued with malafide intention with a view to vex and to harass the petitioner.

(iv) to hold that the impugned proceeding has been initiated in complete violation of the principle of natural justice.”

After some arguments, learned counsel for the petitioner submits that he will respond to the notice dated 07.08.2025 issued by the Additional Collector in the Jamabandi Case No. 56 of 2025-2026 (State vs. Amitabh Singh).

The submission is that all the documents that he has in his favour including the Patna High Court’s order shall be presented before the concerned authority and the prayer is that he should look into it before a final order is passed.

Learned State counsel submits that a simple notice has been issued and each and every document to be filed by the petitioner has to be taken note of before an order has passed.

Recording the submissions of the parties and expecting the Additional Collector, West Champaran to act in accordance with law after going through the documents of the parties/their submissions, the writ petition is disposed of.
