Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State.

With the consent of both the parties, this writ application is being disposed of at the admission stage itself.

This writ application has been filed for the following reliefs:-

“For quashing the order dated 13-12-2025 passed by Sub-Divisional Officer Rohtas (Sasaram)( Respondent no.- 03) by which the respondent no.- 03 is to going cancelled the Licence of petitioner on a ground that you were the dealer of shop of Public Distribution System. Therefore the allegation level against the petitioner that he has should the Ration. Which was use the distributed the Ration such as (rice and wheat) such as this Ration was alloted by the respondent no.- 4 to the petitioner.”

At the outset, learned counsel appearing on behalf

of the petitioner submits that the petitioner has filed the representation with respect to his claim before the SubDivisional Officer, Rohtas (Sasaram) on 13.01.2026, however, till date no order has been passed on the representation of the petitioner. He further contends that he would be filing a fresh representation with all supporting document annexing all the representation filed earlier with respect to claim of the petitioner before the Sub-Divisional Officer, Rohtas (Sasaram) within a period of two weeks and the concerned respondent may be directed to consider and dispose of the representation of the petitioner within a reasonable time period.

To the aforesaid prayer being made by learned counsel

for the petitioner, learned counsel appearing for respondent does not have any objection.

Considering the limited nature of prayer being made by learned counsel for the petitioner, this writ application is disposed of granting liberty to the petitioner to file a fresh representation annexing all the earlier representation before the Sub-Divisional Officer, Rohtas (Sasaram) i.e. respondent no. 3 within three months from today and if such representation is filed within the stipulated time, then the Sub-Divisional Officer, Rohtas (Sasaram) i.e. respondent no. 3 shall dispose of the same

within a period of three months from the date of receipt of the representation, after giving an opportunity of hearing to the petitioner.

Needless to emphasize that the final order which shall be passed by the Sub-Divisional Officer, Rohtas (Sasaram) i.e. respondent no. 3 should be a reasoned and speaking order.

This Court has not expressed any opinion on the merit of the case including maintainability of the writ application.

With the aforesaid observation/direction and liberty granted, this writ application is disposed of.

All pending interlocutory application(s), if any, shall stands disposed of.
