Kale Bahadur Chhetri v. The State of Bihar
Case brief
What is this about?
Vehicle auction notice challenge after confiscation under Bihar excise/prohibition law; SSB seizure of illicit Nepali liquor at Sitamarhi (truck NL01AD1699, 19.07.2021); confiscation, appeal and revision orders attaining finality; earlier writ C.W.J.C. No. 4982 of 2022; Bihar Prohibition and Excise (Amendment) Rules, 2022, Rules 12(A) and 57(B); Shanti Devi v. State of Bihar (C.W.J.C. No. 10227 of 2022) distinguished; release of vehicle on payment of penalty refused; writ petition barred by delay and laches (more than four years); Patna High Court CWJC No. 1350 of 2026, decided 09-02-2026.
What did the court decide?
With the confiscation order dated 03.09.2021 upheld in appeal (29.10.2021) and revision (17.02.2022) and not interfered with by this Court in the earlier round (C.W.J.C. No. 4982 of 2022), the sole consequence is auction of the vehicle, which has already taken place; therefore the challenge to the auction notice dt. 22.01.2022 at this juncture is not tenable in the eyes of law and the writ petition is fit to be dismissed being bereft of merit.
