The learned counsel for the petitioner submits that the petitioner is ready for participating in arbitration proceedings, in case an Arbitrator

is appointed and seeks intervention of this Court, in order to cut short the long process.

The learned counsel for the respondents submits that the Director, Census Operations, Bihar State Co-opearative Bank Bhawan, Ashok Rajpath, Patna is out of station and some time may be granted to take instructions.

List this case on 1703.2020 under the heading “For orders.”

On perusal of the above order, it is evident that the submission made by both parties is that the agreement contains an arbitration clause for invoking arbitration to settle the dispute between the parties without filing the present Writ petition.

At this stage, the Learned counsel for the petitioner seeks permission to withdraw the Writ petition with liberty to file an appropriate request case before the Hon’ble Chief Justice for appointment of an arbitrator.

Considering the submission of the Learned counsel for the petitioner and also the material on record, which clearly disclose that the dispute between the parties shall be referred to
