This writ petition has been filed for the following

reliefs:-

“(i) For issuance of writ in the nature of Mandamus or any other appropriate writ for commanding the respondents to extend and grant of the same benefits such as seniority, annual increments, ACP etc. to the petitioners (Serving/officiating or superannuated) as has been extended to the similarly situated employees who were appointed earlier pursuant to the same advertisement and panel through the petitioners appointed belatedly due to action/inaction on the part of the respondent authorities.

(ii) For issuance of a writ in the nature of Mandamus or any other appropriate writ for commanding the respondents to extend all the benefits to the petitioners as aforesaid by notionally, before joining and actually after joining and actually after joining with effect from the date of employees admittedly junior to the petitioners joined and received.

iii) For holding that unequal treatment to equally situated employees in the matter of salary, annual increments, A.C.P. and other benefits would amount to denial of right to equally enshrined at Article 14 and 16 of the Constitution of India.

iv) For issuance of any other appropriate writ, order (s) or direction(s) which your Lordships may deem fit and proper in the facts and circumstances of the case.”

Learned counsel for the petitioners submit that the issues have already been settled by Hon’ble Apex Court in Balwant Singh Narwal & Ors. v. State of Haryana & Ors. (2008) 7 SCC 728, and that the petitioners case is also covered by the judgment of this Court in CWJC No. 15663 of 2022 (Santosh Kumar & Ors. vs. State of Bihar & Ors. ). The authorities may therefore be directed to adjudicate the claims of the petitioners, for which representations have already been filed.

On the other hand, learned counsel for the State does not dispute the factual position and submits that the petitioners may be directed to file individual representations, providing details of their service profile along with supportive materials for adjudication of their claims.

Considering the above, the petitioners are directed to file their individual representations, along with all supportive documents and the judgment relied upon by them (AnnexureP/2) within four weeks. On receipt thereof, the authorities are obliged to adjudicate the claims of the petitioners by passing a

reasoned and speaking order within a further period of eight weeks. The benefits to which the petitioners are entitled shall also be extended within the same period.
