Patna High Court, Criminal Writ Jurisdiction Case No.356 of 2022 (Jitendra Kumar, J., oral judgment dated 10-03-2026): Five petitioners of one family sought a writ of mandamus directing initiation of departmental proceedings against police officials and the Judicial Magistrate, and initiation of contempt proceedings against the police officials, complaining that petitioner No.2 (Rajiv Kumar) was arrested on 22.06.2021 in Amarpur P.S. Case No.284 of 2021 (Sections 341, 323, 504 read with Section 34 IPC; Section 498A IPC added on 23.06.2021 by the Chief Judicial Magistrate on the police application) without the Section 41A Cr.PC compliance required by the directions in Arnesh Kumar v. State of Bihar, (2014) 8 SCC 273, an offence carrying maximum punishment below seven years. Held: the arrest and remand were never challenged; petitioner No.2 instead moved a regular bail application which was allowed on 18.01.2022 by a Coordinate Bench and he was released, and the other petitioners were never arrested; hence the grievance regarding Arnesh Kumar compliance and initiation of departmental or contempt proceedings is unwarranted at this stage, the Court relying on Lallan Kumar Yadav vs. State of Bihar and Ors., 2026 (2) BLJ 414 (Criminal Writ Jurisdiction Case No.1049 of 2021), where obtaining regular bail without challenging the arrest or remand was treated as acquiescence rendering the arrest 'legal' for want of setting aside the remand. Writ petition dismissed. The Court, however, recorded that dismissal does not amount to approval of the conduct of the police or the Magistrate: the case diary shows the investigating officer totally oblivious of the Arnesh Kumar directions and the Judicial Magistrate apparently ignorant of the guidelines, although a Magistrate is duty bound to verify compliance before remanding and to reject the remand application absent compliance. The Court reproduced the Arnesh Kumar directions (paras 11, 11.1-11.8 and 12) and the reiterated directions in Mohd. Asfak Alam v. State of Jharkhand, (2023) 8 SCC 632, and, quoting para 17 of Lallan Kumar Yadav (supra), the direction to the Registrar General to circulate the order among Judicial Officers and to the Director General of Police, Bihar for circulation among police officials. It was also stated by counsel that Criminal Miscellaneous No.12667 of 2022 under Section 482 Cr.PC for quashing the F.I.R. has been filed by the petitioners.
