Heard learned counsel for the parties.

The present writ petition has been filed seeking

¶26

following reliefs:

“(i) Commanding the respondent authorities particularly the Resp. No.-4 & 6 to do/ensure the life, liberty & property of the petitioner from the

Resp. No.-7 to 11 who are continuously threatening to face the consequences.

(ii) Further commanding the respondent authorities particularly the Resp. No.-6 to ensure the free & fair investigation concerning to the Khusrupur P.S. Case No.-474/2025 dt.-30.11.2025 U/S-190, 191 (2), 115 (2), 126 (2), 109 (1), 352 and 351 (2) of B.N.S.

(iii) Further commanding the respondent authorities to act and follow with the specific provisions of the police manual for the purpose of investigation.

(iv) For grant of any other incidental/consequential relief/reliefs, for which the petitioner can be found entitled for.”

Learned counsel for the petitioner submits that

respondent nos. 7 to 9 are cousins of the petitioner and respondent nos. 10 and 11 are his nephews. Learned counsel further submits that due to land dispute the respondents have always been threatening and demanding money from the petitioner and they also used to beat him. The petitioner has also filed Khusrupur P.S. Case No. 474 of 2025 registered for the offences punishable under Sections 190, 191(2), 115(2), 126(2), 109(1), 352 and 351(2) of the B.N.S., 2023 against the respondents. But the authorities are not properly investigating the matter and the authorities are also not providing any security to life, liberty and property of the petitioner. Learned counsel

further submits that respondent no. 8 is a renowned criminal and is accused in altogether twelve cases and in most of the cases he has been declared absconder. Respondent no. 8 stays in the village and threatens the petitioner, but Police is not taking any action against him.

Learned counsel for the State respondents submits that the Police authorities are taking action whenever complaint has been made and on the complaint made by the petitioner, Khusrupur P.S. Case No. 474 of 2025 has been registered against the respondent parties and so it is not correct to say that respondent authorities are not taking any steps on complaint made by the petitioner. Learned counsel further submits that there appears to be a property dispute between the parties, petitioner and the private respondents and the present writ does not appears to be maintainable. However, he admits that if respondent no. 8 has been declared absconder in a number of cases, the authorities should have taken action against respondent no.8.

I have perused the record.

Having regard to the rival submissions advanced by the parties, the present writ petition could be disposed of with a direction to the respondent nos. 4 and 6 to take action whenever

there is any complaint regarding threat to life and liberty of the petitioner or his property. The petitioner can approach the authorities if any such threat is extended to him by any person and the authorities will act in accordance with law on receipt of such complaint. Further, the respondent nos. 4 and 6 are also directed to look into the nature of allegation against respondent no. 8 and if he is an absconder in a large number of cases, take

action against respondent no. 8 in accordance with law.

Accordingly, in terms of aforesaid directions, the present writ petition stands disposed of.
