2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 109 and 3 (5) of the BNS and Sections 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. The case of the prosecution is that two persons on a bike arrived while the petitioner on his hardware shop. It is alleged that they started firing and specially the pillion rider opened fire. The informant saved himself after which the accused persons fled away from the spot.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in

connection with the present case. It is further submitted that he was apprehended in Manjhi P.S. Case No. 270 of 2025 and in that case he has given his confessional statement and on the basis of that confessional statement, he has been framed in this case. It is further submitted that no one has injured in the alleged occurrence and no empty cartridges were recovered from the place of occurrence. Moreover, the petitioner is languishing in judicial custody since 04.08.2025.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Ekma P.S. Case No. 262 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1^st Class, Saran.
