The petitioner has prayed for bail in connection with Patna Cyber P.S. Case No. 1670 of 2025 registered for the offence punishable under Sections 318(2), 318(4), 319(2), 111(2)(b), 317(2), 317(4), 61(2) of B.N.S. and Sections 66(C) and 66(D) of the I.T. Act.

The case of the prosecution, in short, is that the informant received a secret information that certain miscreants are indulged in cyber crime in the house of Ranvijay Kumar. On this information, the house of Ranvijay Kumar was raided and from that house, petitioner along with others was apprehended and from the room, Laptop and mobiles were recovered. On being asked the petitioner along with others have disclosed that

they were indulged in cheating the common man through gaming app Gol365.green, Laser247.Pro and M.D. (Mahadev) Panel.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. Nothing has been recovered from the possession of this petitioner. Recovery, if any, has been made from the house of Ranvijay Kumar. It has further been submitted that there is no allegation that the petitioner has cheated anybody. It has also been submitted that the real fact is that the petitioner along with others was playing online game and the articles which have been seized are of the petitioner and others. Petitioner is languishing in judicial custody since 21.07.2025.

Learned APP appearing for the State has vehemently opposed the application for bail and has submitted that from perusal of the order of the learned trial Court, it is clear that earlier two compliant cases have been registered by Durgesh Mishra and Manindar against the two gaming account which has been logged in seized laptop and phone of the accused person.

petitioner has submitted that the gaming apps against which account the compliant cases have been registered were found in the mobile of Nitish Kumar not from this petitioner.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned J.M. 1^st Class, Patna in connection with Patna Cyber P.S. Case No. 1670 of 2025.
