Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 80, 238 and 3(5) of the BNS.

The case of the prosecution, in short, is that Sarita Kumari (deceased) was married to the petitioner six years ago. It is further alleged that she was subjected to cruelty on account of nonfulfillment of dowry demand by her in-laws. The deceased has three children out of the wedlock. The deceased was assaulted by her in-laws and the deceased used to communicate it to the informant. It is further alleged that on 09.04.2025 the petitioner called the informant that the deceased has died. On 10.04.2025, when the informant went to the matrimonial house of the

deceased, she came to know that deceased was taken to Hathidah Ghat for cremation. The informant reached there and did not found her daughter there. Then she got information that the petitioner along with his brother and mother had went to Umanath Ghat, Barh for cremation of the body of the deceased. Then the informant sent her relatives to Umanath Ghat, Barh for enquiring about her daughter and the informant went to Bannubagicha Police Station for informing the police about the occurrence.

Learned counsel for the petitioner submits that from perusal of the case diary it will transpire that the witnesses have stated that they came to know that the deceased has committed suicide. Witness Bheem Yadav has stated in Paragraph ‘45’ of the case diary that as he was going towards his fields, he found crowd before house of petitioner; when he went there he came to know that the deceased has committed suicide. After this, the neighbourers alighted the deceased. The witnesses have stated that the petitioner used to live outside for his livelihood.

Learned counsel for the petitioner has further submitted that from perusal of the post-mortem report also it will transpire that the Doctor conducting autopsy of the deceased has found V-shape ligature mark present between larynx and chin and has opined that no any external injury over body except ligature mark. Cause of death is Asphyxia due to hanging.

Learned counsel for the petitioner has further submitted that the witnesses have also supported that the deceased has committed suicide and the post-mortem report also goes to show that it is a case of hanging. Learned counsel for the petitioner has lastly submitted that the petitioner is having no criminal antecedent and he is in judicial custody since 11.04.2025.

Learned APP for the State has vehemently opposed

the bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bannubagicha P.S. Case No. 24 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-III, Lakhisarai.
