APP for the State, learned counsel for the informant and perused the case diary.

The petitioner seeks bail in connection with Khushrupur P.S. Case No. 43 of 2025, instituted for the offences punishable under Sections 191(2), 191(3), 190, 103(1), 115(2) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.

The prosecution case, in short, is that informant’s family was attacked at their home by FIR named accused with deadly weapons, and his son Amol Kumar was shot by coaccused Gautam Kumar. Amol sustained gunshot injury and died on the way to NMCH during treatment.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Charge-sheet has been submitted in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Learned counsel for the petitioner also submitted that no specific allegation has been attributed against the petitioner rather the same is general and omnibus in nature. It is next submitted that specific allegation of firing is against co-accused, namely, Gautam Kumar. The petitioner is in custody since 24.07.2025 and has got no criminal antecedent. Learned counsel for the petitioner further submits that other coaccused has been granted regular bail by Court vide order dated 31.07.2025 passed in Cr. Misc. No. 49359 of 2025.

Learned APP for the State and learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioner.

Considering the aforesaid facts and circumstances of the case and taking into account the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) with two
