The petitioner apprehends his arrest in connection with Pipra P.S Case No. 89 of 225 registered for the offences punishable under Sections 109, 3(5) of BNS and Section 27 of the Arms Act.

As per the prosecution case, petitioner along with co-accused fired bullet upon the son of the informant.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is next submitted that petitioner has got no criminal antecedent as stated in para 3 of the bail petition.

Learned counsel for the State opposes the prayer

for bail of the petitioner.

From perusal of the F.I.R., impugned order and materials available on record it appears that injured in his statement stated that two unknown has approached and shot the bullet on him. In his statement, he has also denied the involvement of the petitioner in the aforesaid incident. Petitioner has got clean antecedent as stated in paragraph no. 3 of the bail petition.

Considering the aforesaid facts and circumstances of the case, submissions made on behalf of the petitioner, let the above named petitioner be released on bail in the event of his arrest or surrender before the trial court within a period of six weeks from today on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned JMFC, Supaul in connection with Pipra P.S Case No. 89 of 225 subject to the condition laid down under Section 482(2) of B.N.S.S.
