The petitioner has prayed for bail in connection

with Chitragupta Nagar P.S. Case No. 03 of 2025 registered for the offence punishable under Sections 331(4) and 305 of B.N.S.

The case of the prosecution, in short, is that some unknown miscreants have committed theft at the house of the informant and jewellerry and valuables were stolen.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. The F.I.R. was lodged against unknown miscreants. During course of investigation, one co-accused Chotu Kumar has given his confessional statement and in his confessional

statement, name of this petitioner has surfaced. Nothing has been recovered from his possession. He is languishing in judicial custody since 20.08.2025. It has has also been submitted that co-accused Chotu Kumar has been granted bail by learned Co-ordinate Bench of this Court vide Cr. Misc. No. 63372 of 2025 and other co-accused persons have also been granted bail by learned Co-ordinate Bench vide Cr. Misc. No. 62411 of 2025.

Learned APP appearing for the State has vehemently opposed the application for bail and has submitted that petitioner is having criminal antecedent of two cases.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned J.M.F.C., Patna in connection with Chitragupta Nagar P.S. Case No. 03 of 2025.
