Heard learned counsel appearing on behalf of the petitioner and learned APP for the State.

The petitioner seeks pre-arrest bail in connection with Mainatand P.S. Case No. 102 of 2025 registered for the offence punishable under Sections 118 (2), 109 and 3(5) of the BNS.

Prosecution case, in brief, is that on 22.05.2025 at about 11:00 A.M., two minor boys, Ranjeet Manjhi and Deepak Manjhi, sustained injuries after coming into contact with a live electric wire surrounding the orchard of accused Lal Babu Prasad. They were rescued by locals and taken to Mainatand Hospital for treatment. It is further alleged that despite prior warning, the accused failed to disconnect the electric supply, resulting in the incident.

Learned counsel appearing on behalf of the petitioner submitted that the petitioner is innocent. Because his father is the owner of the orchard, based on the false allegation, he has been named in the F.I.R. The injury sustained by the victim is simple in nature.

Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioner.

Having heard the rival submissions made on behalf of the parties, as well as, having perused the allegation made in the F.I.R. and the injury sustained by the victim, as per the opinion of the doctor, is simple in nature, the petitioner, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned District Court where the case is pending in connection with Mainatand P.S. Case No. 102 of 2025, subject to the condition as laid down under Section 438(2) Cr.P.C / 482(2) BNSS.
