Petitioner apprehends arrest in a case registered for the offences punishable under Sections 30 (a) of the Bihar Prohibition and Excise Act and section 414 of the IPC .

3 . As per prosecution case, 50.400 liters illicit Nepali wine was recovered from the seized motorcycle .

It is submitted that the petitioner is innocent and has falsely been implicated in this case . Petitioner is neither owner nor driver of the seized vehicle . No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery.

Considering the facts of the case , in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge 1^st Sitamarhi District- Sitamarhi in connection with Sonbarsa Police Station Case No. 149 of 2021 , subject to the conditions laid down under section 482 ( 2 ) of the BNSS 2023 .
