appearing for the petitioner and Mr.Mukesh Kumar Singh, learned Additional Public Prosecutor for the State.

The petitioner seeks bail, who is in custody since 08.07.2025 in connection with Gogari P.S. Case No. 214 of 2022, G.R. No. 2293 of 2022, F.I.R. dated 16.08.2022 registered for the offence punishable under Sections 25(1-b)a/26(1) of Arms Act.

Earlier the petitioner has been granted bail by this Court vide order dated 12.04.2023 passed in Cr.Misc.No.73315 of 2022. While granting bail, one of the conditions that “the court below shall verify the criminal antecedent of the petitioner and in case at any stage, it is found that the petitioner has

concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification”. The bail bond of the petitioner was cancelled on 02.06.2025 on the basis of the petition filed by the A.P.O. stating therein that the petitioner carries nine more cases other than the present one in the district of Khagaria and petitioner has mentioned in the bail petition that only three cases are pending against him.

Learned senior counsel appearing for the petitioner submits that earlier the petitioner was in custody for about eight months and now he is in custody since 08.07.2025.

Learned A.P.P. for the State, on the other hand, have vehemently opposed the prayer for bail of the petitioner and submits that the petitioner carries thirteen more cases other than the present one but fairly submits that out of thirteen cases, the petitioner is on bail in nine cases, in three cases, the petitioner has been acquitted and rest one case is pending for consideration before the competent court of law, as mentioned in para-3 of the bail petition.

Considering the nature of allegation against the

petitioner in the FIR and taking into consideration that the petitioner has earlier been granted bail by this Court, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1^st Class, Khagaria in connection with Gogari P.S. Case No. 214 of 2022, G.R. No. 2293 of 2022, with the following conditions:-

(I) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on his/her absence on two consecutive dates without sufficient reason, his/her bail bond shall be cancelled by the Court below.

(II) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.

(III) And, further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage, it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order
