No. 295 of 2024 registered for the offence punishable under Sections 61, 103(1), 238 and 3(5) of the B.N.S.

The case of the prosecution, in short, is that minor son of the informant was being taken away by Ravi Ram and Vinod Ram and they have killed the minor son (deceased) of the informant by pressing his neck. It is further alleged that Jahuri Ram was carrying the deceased in his lap. When the villagers saw him and raised alarm, Jahuri Ram threw the boy in the field and fled away.

Learned counsel appearing on behalf of the petitioners has submitted that the allegations levelled against the petitioners are false and fabricated and they have falsely been implicated in this case. Learned counsel for the petitioners has submitted that the petitioners are having no criminal antecedent.

Learned counsel for the Informant has vehemently opposed the bail and has stated that from perusal of the report of the learned trial court it is clear that all the prosecution witnesses have been examined in this case and the statement of the accused persons have already been recorded. The case is fixed for defence evidence. The trial is at its fag end.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, I am not

inclined to grant bail to the petitioners at this stage, however, they can renew their prayer for bail after three months if the trial is not concluded. Learned trial is directed to conclude the trial within the said period.
