Heard learned counsel for the petitioner and learned A.P.P. for the State.

In the present case, the petitioner seeks bail in connection with Parbatta P.S. Case No. 151 of 2025 dated 25.04.2025, registered for the offences punishable under Sections 189(2), 191(2), 191(3), 190, 221, 223, 285, 121(1), 132, 324(4), 324(5), 74, 352, 353 and 61(2) of the B.N.S., 2023.

As per the prosecution case, petitioner and other co-accused persons blocked the road protesting against death of one Sikander Mandal @ Shikari Mandal who died in an accident. When the police party reached there and asked the crowd to disperse, the mob attacked the police party with lathi , danda , bricks and stones.

Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in

the present case. No persons from the police party or general public suffered any injuries and there is no complaint whatsoever from the general public. A similary placed coaccused, namely Shiv Yadav has been granted bail by a learned co-ordinate Bench of this Court vide order dated 17.01.2026 passed in Cr. Misc. No. 77459 of 2025. Learned counsel next submits that petitioner is having antecedent of seven cases and he has been acquitted in four such cases and he is on bail in three cases. Learned counsel lastly submits that petitioner is in custody since 04.12.2025 and chargesheet has been submitted.

Learned A.P.P. appearing on behalf of the State opposes the submissions made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the non-specific nature of allegation and grant of bail to similarly placed co-accused person and considering the petitioner’s period of custody and submission of chargesheet, the petitioner, abovenamed, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1^st Class, Khagaria / concerned Court, in connection with Parbatta P.S. Case No. 151 of 2025 , subject to
