Heard learned counsel for the petitioner and

learned APP for the State.

The petitioner is apprehending his arrest in connection with Rampur P.S. Case No. 506 of 2025 for the offence under Sections 126(2), 115(2), 352, 329(4), 109(1), 351(2), 351(3) and 3(5) of the BNS and Section 27 of Arms Act.

As per the prosecution story, the informant has alleged that on 01/10/2025 at around 10 PM, while he was going to the market with his daughter, he was assaulted by Mrityunjay Yadav, Nandan Yadav, Chandan Yadav (petitioner), and others. On 02/10/2025 at around 1:00 PM, the same group of about 12 known persons, along with 10–

15 unknown accused persons, returned, verbally abusing him and banging at his door. When the informant went to the terrace, co-accused-Nandan Yadav fired 5–6 rounds from his pistol upon the informant, but he somehow escaped himself.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence rather he has falsely been implicated in the present case due to local politics and personal enmity. There is neither any injury report nor any allegation of assault has been made against the petitioner whereas all the allegations are general and omnibus in nature and against all the F.I.R. named accused persons including the petitioner.

Learned APP opposes the prayer for bail.

Keeping in view the aforesaid facts, this Court is inclined to extend him the privilege of anticipatory bail.
