Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Sursand P.S. Case No. 301 of 2026, registered under Section 317(5) of B.N.S. and 30(a) of the Bihar Prohibition and Excise Act.

As per the allegation in the FIR, total 315 liters of Nepali saufi wine was recovered from two motorcycle.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the case. The petitioner is in custody since 14.06.2026 and 315 liters of Nepali saufi wine has been recovered from two motorcycle. He further submits that nothing has been recovered from the

conscious possession of the petitioner and petitioner has no concerned about the recovery as well as the present occurrence. Therefore, the petitioner who is of clean antecedent, deserves the privilege of regular bail.

Learned APP for the State vehemently opposes the prayer for grant of bail to the petitioner.

Considering the aforesaid facts and circumstances of the case and also submission of learned counsel for the petitioner, let the above named petitioner be released on bail, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Excise Court – II, Sitamarhi in connection with Sursand P.S. Case No. 301 of 2026.
