The petitioner has preferred this application for grant of regular bail in connection with S. Tr. No. 316 of 2025 arising out of Chutiya P.S. Case No. 18 of 2025 registered for the offences punishable under Sections 103(1) of the BNS.

According to the prosecution, the informant, who is a police official, received information on 15.03.2025 at about 10:30 A.M. regarding the murder of two women near an electricity power grid in village Kala Pahadi. The deceased were later identified as Parvati Devi and Pratima Kumari, whereupon the F.I.R. was instituted against unknown persons.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this

false and fabricated case despite of being husband and father of dead women. There are two persons who have been made accused in the present case, one is the present petitioner and the other one is son of the present petitioner. Learned counsel further submits that both the deceased women died due to electric shock in the field but in support of that, there is nothing in the case diary.

Learned A.P.P. appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

From the perusal of the F.I.R., it appears that two dead bodies, who happen to be the wife and daughter of the petitioner, were found lying near an electric power grid. In paragraph no. 16 of the case diary, the confessional statement of the petitioner has been recorded by the police. Although such a statement is not admissible for proving the guilt of the petitioner but it may be considered to the extent of clarifying the alleged motive. The motive, as disclosed therein, is that the petitioner’s daughter was in love affair with one Sudama Ram, who was already married, and the petitioner intended to arrange her marriage with another person, to which she was not agreeable. It is alleged that, on this account, the petitioner, along with his son, committed murder of his wife and daughter while

they were sleeping in a room. Further, in paragraphs 8, 9, 10, 11 and 12 of the case diary, the witnesses have stated that the deaths appear to have been caused by strangulation. As per para 46 of the case diary, blood stained brown coloured T-shirt of the petitioner as well as mobile phone of the deceased has been recovered. The post-mortem report also indicates that the cause of death was asphyxia due to strangulation, leading to cardiac arrest.

Having regard to the aforesaid facts, the gravity of the offence, and the post-mortem report, this Court is not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail is rejected.
