The petitioner no. 1 has prayed for regular bail in a case registered for the offence punishable under sections 304(B), 201 and 120(B) of Indian Penal Code which was earlier not pressed vide order dated 09.01.2026 on behalf of petitioner no. 1 whereas petitioner no. 2 was granted bail on that day.

The case of the prosecution is that one Pinki Kumari (deceased) was married to the petitioner no. 1. It is further alleged that all the in-laws have assaulted and killed her.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned

counsel for the petitioner has submitted that during course of trial, the informant of this case has been examined as PW-4 and he has been turned hostile by the prosecution. In this crossexamination by the defence, this witness has stated that the information regarding death was given to him by in-laws and he got nervous after seeing the body of the deceased. Somebody has written the application on which, he has put his LTI. The application was not read over to him and he was unaware of the facts written therein. He has categorically stated that the deceased has died due to illness. Learned counsel for the petitioner has submitted that the informant himself has stated that the deceased has died due to illness. Moreover, he is languishing in judicial custody since 06.03.2025 and he has got no criminal antecedent.

Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner no. 1 ( Ashok Kumar Singh) on bail. The above named petitioner is directed to be released on bail in connection with Shyampur Bhatha P.S. Case No. 49 of 2015 on furnishing bail bond of Rs.10,000/- (ten thousand) with
