The petitioners who apprehend arrest in connection with Complaint Case No. 122/2024, lodged, for the offences punishable under sections 498A, 323, 379, 504, 506, 34 of the IPC and Sections 3 and 4 of the Dowry Prohibition Act wherein processes have been issued after cognizance being taken under

Sections 323, 379, 498A, 504, 506, 34 of the IPC and Sections 3 and 4 of the D.P. Act.

As per the prosecution, the accusation is of torture for non-fulfillment of dowry demand. It is alleged that petitioners being the mother-in-law and father-in-law of the complainant inflicted torture upon her for non-fulfillment of dowry demand.

Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Learned Counsel for the petitioners further submits that the allegation against the petitioners, being father-in-law and mother -in-law of the complainant, is general and omnibus. They are residing separately form the husband of the complainant. Moreover, the crux of allegation is against the husband of the complainant who has already been granted bail by the learned Trial Court vide order dated 23.06.2026 passed in B.P. No. 443 of 2026. Learned counsel for the petitioners has produced a copy of order dated 23.06.2026 passed in B.P. No. 443 of 2026 arising out of Complaint Case No. 122 of 2024, by the learned District and Additional Sessions Judge-1, cumSpecial Judge, SC/ST (P.O.A.) Act, Muzaffarpur, which is kept on record.

Learned APP for the State opposes the prayer for bail but fairly submits that the husband of the complainant has been granted bail by the learned Trial Court.

In the facts and circumstances of the case, let the above-named petitioners be released on bail, in the event of their arrest or surrender before the Trial Court within a period of four weeks from today, on furnishing bail bond of 30,000/-₹ (Rupees Thirty Thousand only) each, as mentioned in Section 2(1)(d) of the Bharatiya Nagrik Suraksha Sanhita, 2023 , to the satisfaction of the learned S.D.J.M., Madhepura, in connection with the aforementioned case, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023 .
