Heard Mr. Kumaresh Singh, learned counsel appearing on behalf of the petitioners and Mr. Binod Kumar, learned Additional Public Prosecutor for the State as well as Mr. Ujjwal Raj, learned counsel appearing for opposite party No. 2.

This application has been filed for quashing of order dated 25.09.2024 passed by the learned ACJM-XI, Patna, in Complaint Case No. 10984 (C) of 2023, whereby cognizance has been taken against the petitioners and direction for issuance

of summons has been made against the petitioners under Section 406 of the IPC.

Both the parties have jointly prayed that the matter has been settled between the parties without any threat, promise or coercion and it has further been submitted that good sense has prevailed between the parties and they do not want to pursue the case any further.

Learned counsel for opposite party No.2/complainant has drawn the attention of this Court to Annexure-P/4, wherein a petition was filed before the learned court below for withdrawal of the case way back in the year 2024, but till date no order has been passed. It has also been submitted that the offences are compoundable in nature.

In view of such joint statement by learned counsel appearing on behalf of the petitioners as well as learned counsel for the opposite party No. 2 and in the interest of justice, the impugned order dated 25.09.2024, passed by the learned ACJMXI, Patna, in Complaint Case No. 10984 (C) of 2023, is hereby quashed.
