In the present case, the petitioner seeks bail in connection with Gaura P.S. Case No. 21 of 2026, registered for the alleged offence under Sections 126(2), 115(2), 109, 303(2), 352 and 3(5) of BNS.

As per prosecution case, the petitioner and other coaccused persons assaulted the daughter-in-law of the informant with lathi and danda and also snatched her mangalsutra . The occurrence took place in the background of previous dispute between the parties.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. No occurrence in the manner as alleged has ever taken

place. Though there is allegation that the daughter-in-law of the informant was brutally assaulted and she had been lying covered with blood all over, but the injury report falsifies the allegation as the injury on the daughter-in-law of the informant was found simple and the injuries are pain & swelling in right knee, left leg, right hand, left hand and on face and the number of injuries stated to be one. No fracture or dislocation of any bone or joint was found. The learned counsel further submits that the petitioner is having antecedents of six cases. The learned counsel further submits that the petitioner and the informant are agnates and there is counter version and the petitioner has filed Gaura P.S. Case No. 61 of 2025 against the informant’s side. The petitioner is in custody since 07.02.2026. The charge sheet has been submitted.

Learned APP for the State opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the simple nature of injury and further considering the case and counter case of the parties and also considering the submission of charge sheet against the petitioner and his period of custody, the petitioner above named is directed to be released on bail on

furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Saran at Chapra/court concerned in connection with Gaura P.S. Case No. 21 of 2026, subject to the conditions mentioned in Section 480(3) of BNSS and the following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

¶25

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
