Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 281 125, 324(4) and 3(5) of BNS and Sections 8, 20(b) (ii)(B), 25 and 29 of the NDPS Act.

The case of the prosecution is that from a tempo, altogether 18.5 kg of ganja was recovered.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Learned counsel for the petitioner has submitted that the petitioner was merely a passenger of that tempo. Nothing has been recovered from his

possession. He is not concerned in any way with the alleged tempo. Learned counsel has further submitted that while making seizure, Section 105 of B.N.S.S. has not been complied and the seizure list witnesses are police personnel. Learned counsel has further submitted that the tempo has dashed the bike of a police personnel that is why, the tempo was being detained by police and the petitioner has been framed in this case. It has also been submitted that though the quantum of the contraband which has been recovered from the possession of this petitioner is more than small quantity but is less than commercial quantity. Petitioner is having no criminal antecedent. Moreover, he is languishing in judicial custody since 28.01.2026.

Learned APP appearing for the State has vehemently opposed the prayer of regular bail and has submitted that as per the FIR, the petitioner is associate of the Neeraj who is the driver of that tempo.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Naugachia P.S. Case No. 30 of 2026 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount
