Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Muffasil P.S. Case No.280 of 2025 instituted under Sections 303(2), 317(2), 111(3) of the B.N.S., 2023.

As per the prosecution case, the informant has alleged that a joint raid was conducted against illegal sand mining under the jurisdictions of Giriyak and Pawapuri Police Stations, District Nalanda. On seeing the raiding team, all the tractor drivers fled away with loaded vehicles towards Mufassil P.S. who were chased and when surrounded the drivers of the vehicles abandoned their tractors and motorcycles near the sand

storage site of petitioner.

Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. He further submits that the Tractor does not belong to the petitioner rather the driver of said tractor fled away leaving the tractor on the road. Learned counsel submits that petitioner was not present on the spot at the time of alleged occurrrence. He further submits that petitioner is a lady, having got clean antecedent and she undertakes to cooperate in the investigation and trial of the case.

Learned A.P.P. for the State opposes the prayer for anticipatory bail.
